MiCAR 3 years later: a look back and lessons for the future

The Markets in Crypto-Assets Regulation (“MiCAR”) is the EU regulation introducing a coherent and holistic framework for professionals wanting to market crypto-currencies, tokens, and other such assets in a regulated manner. Taking inspiration from the similar regulation for financial instruments, MiCAR promised to move this market into the regulated space like other supervised entities in the banking, payments and more broadly in the financial sector.
How does the regulation aim to achieve this goal - not only for potential service providers, but also prospective investors looking to make use of them to enter into the crypto-space - and what is the lessons learned now 3 years after its introduction?
This presentation will focus on a general overview of the main points stemming from MiCAR, i.e., the ART, EMT, and the CASPs.
Participants will learn the reasons and origins of the regulation, as well as the legal framework explained on a high-level basis regarding both the assets and the service providers active in the crypto-market.
This will translate the obligations and what they mean for both the stakeholders looking to provide such crypto-assets or services within MiCAR, and investors or more generally people interested in entering this space through such assets or services, particularly in terms of risk, transparency, supervision, and solvency considerations.
The presentation will also focus on giving an overview of the current ecosystem in Luxembourg and give some practical considerations after 3 years of authorities and stakeholders putting this regulation into action.
